All purchases are made pursuant to a shipment contract. Title and risk of loss pass to you when we deliver items to the carrier.

If your order arrives damaged, defective, incomplete, or incorrect, report it within 48 hours of delivery as described in our Shipping Policy. We will file the claim with the carrier for you and send a replacement or refund at no cost to you. This service does not change when title and risk of loss pass to you.

5.3 Installation

Products must be installed according to the manufacturer's instructions and applicable codes, and by a qualified, licensed professional where the law or the manufacturer requires it, including for gas connections. We do not perform, supervise, or warrant installation. Any installer we refer you to is an independent business that contracts with you directly.

If the dispute cannot be resolved informally, both parties agree to settle it through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in the United States, and the arbitrator's decision will be final and binding.

This agreement and any dispute arising from it will be governed by the laws of FL, without regard to its conflict-of-law provisions.

Class Action Waiver:

Customers agree that any dispute will be resolved individually, and not as part of any class action, consolidated, or representative proceeding.

Exceptions:

Either party may bring a claim in small claims court if eligible or seek injunctive relief for alleged infringement or misuse of intellectual property rights.
